My newly formed non-profit theater is being offered to present a show in November. A dance studio(for-profit) needs me to secure the venue and to present their show. The distributedof funds are suggested: 70% (theirs) and 30%(ours)? Sounds good to me as we won't have a lot of work to do and it is basically free funds....or is it too good to be true? Am I not thinking clearly or am I forgetting something? Is this legal in the eyes of non-profits? I don't want my first show to start out on the wrong foot.

They will purchase and keep all costumes.
 
Merchandise and concessions sold are uncertain to me. Do they get that or do we split that too? The theaters name will be on all merchandise. Where do I find information on this? I will be meeting with them next week after securing a venue, but not signing a contract.
 
Who pays for what and who is responsible for insurance? 
 
Please help with your suggestions.

The most important thing is to understand who is responsible for what. This needs to be mutually decided between your group and the dance company. I have run into cases in the past where what seemed like a simple outside rental, became more and more of a burden on the host theater. Some things to think about...
 
- How long will they need the space? Will the need it for rehersals or just performanceS?
 
- Who will provide technicaly staff; lighting people, sound people, stage crew etc?
 
- Who will handle pre-sale tickets, will they do it or will your box office do it?
 
- Who will provide the ticket and refreshment staff during the performances?
 
- As you already mentioned, how will refrehments be delt with. The split there might have to be different depending on who provides the product.
 
- Who will handling advertising?
