Has anybody here ever been involved in any kind of lawsuit that was a result of something that happened in your theater? This topic seems to be only too rarely talked about in theatre corners. I guess it doesn't happen too often but it would be helpful to at least be somewhat informed about incidents such as this occurring in theaters. "Lawsuit" is one of those buzz words that everyone fears will happen someday.

We have never been involved in a lawsuit, but we do have lots of safety measures and precautions in place that will hopefully always keep us out of that position. We have good insurance, which is costly, but does allow us to sleep better at night. We also have an incident report process that ensures we follow an established set of guidelines when something happens. The most serious thing we have ever had happen was when a director failed to get medical treatment for an injury sustained during set building. The injury became far worse, resulting in huge medical expenses. We settled with him via our insurance since he had been negligent in getting treatment. We kept careful records of all of our discussions with him and then relied on our coverage to take care of the cost. When something like someone falling happens, as it will occasionally, we complete an incident report, ensure that we stay in contact with the individual to see what sort of treatment -- if any -- is required, keep our insurance agent informed and complete a follow-up with all parties to make sure the details are handled. But the best thing to do is prevent these things as best you can with good lighting inside and out, attentive ushers and staff, lots of ice melt :-), and ensuring that all volunteers are supervised by someone who knows the theatre well and can handle any emergency. No one is left unsupervised, we see that all patrons get to their cars safely (we're in a marginal part of town) and double-check doors and equipment. We also remain on good terms with a pro-bono attorney who will help us in the case of something going beyond our already established procedures. We may never need him, but he's there if we do. We give him tickets and publicity.
